Dear colleagues, friends and lifesavers 

 

We are overjoyed to be able to announce the following merry statement:

After several discussions with SUISA regarding the outstanding payments we were at last able to reach a compromise that will prove itself to be a good solution for both sides.

 

We have done a complete disclosure and have provided SUISA with detailed information on the basis of which a new and significantly lower bill was issued compared to the original estimate. For the future we plan on working closely together with SUISA within the contractual framework of a long-term agreement. Just to remind you; during the course of January 2009 we received demand for payment of roughly CHF 42,000 which was the cause for our desperate plea for help and donations.

 

Thanks to numerous donations, the incredible loyalty shown by fans, press and other media, a host of benefit shows as well as the cooperation with SUISA we are now able to proudly proclaim: WE ALL SAVED VOODOO RHYTHM! We are completely overwhelmed and can hardly express our gratitude for all this support thanks to which Voodoo Rhythm is able to continue going. There will however be a number of changes and restructurings that will need to be made in order to meet all the agreed upon requirements.

 

Here some quick figures:

Through the help of the donations as well as the benefit shows we were able to raise some CHF 46,000 – which is absolutely mind-blowing! After the payment for the intellectual property rights for the years 2008 and 2009 (a contractually agreed instalment payment) we are left with some CHF 20,000. We plan on investing this excess in the following:

 

  • All Voodoo Rhythm bands that sent money in support will have these amounts refunded, which amounts to ca. CHF 4,000

 

  • We will invest in some desperately needed infrastructure. The new billing system required by SUISA necessitates a proper accounting system, which up until now has bee done the “ Beat-Man Way ”. Here we will need to get accounting software that meets our requirements as well as quite a few hardware items. (If anyone can help here with advice or deeds: PLEASE CONTACT US!) We do not know as of yet how much this will cost us but it certainly will not be cheap. However, all this is very much necessary in order to avoid a repeat of such a horrible situation.

  • The excess allows us for now to continue giving the bands the same deals they have been getting so far. (Free copies plus cheap self-purchases of records)

  • We will be able to continue releasing underground music, at least for now.

Wir freuen uns riesig, Euch folgende freudige Botschaft mitteilen zu können:

Nach mehreren Gesprächen mit der SUISA über die ausstehenden Zahlungen konnten wir letztendlich eine gute Lösung für alle Beteiligten finden.

 

Wir haben die Hosen runter gelassen und aufgrund der eingesendeten Unterlagen und von uns gemachten, detaillierten Angaben konnte uns die SUISA eine neue Rechnung stellen, die deutlich tiefer ausfällt als die ursprüngliche Schätzung. Für die Zukunft wollen wir im Rahmen eines langfristigen Vertrages eng mit der SUISA zusammenarbeiten.

Zur Erinnerung: im Januar 2009 flatterte eine Rechnung von rund 42.000 CHF in Haus, die uns zu Hilfeschreien und Spendenaufrufen veranlasste.

 

Dank der zahlreichen Eingänge, der unglaublichen Loyalität seitens Fans, Presse und anderer Medien, den zahlreichen Benefiz-Veranstaltungen und dem Entgegenkommen der SUISA könnt Ihr stolz behaupten: WE SAVED VOODOO RHYTHM!

Unserer grenzenlosen Dankbarkeit können wir kaum Ausdruck verleihen, dank all dieser Aktionen besteht Voodoo Rhythm weiter. Doch es werden einige Neuerungen und Umstrukturierungen nötig sein, um den geforderten Anforderungen Folge zu leisten.

 

Hier eine kleine Hochrechnung:

Wir haben aus Spenden und Benefiz-Veranstaltungen ca. 46.000 Franken einnehmen können. Das ist der absolute Wahnsinn!

Nach Begleichung der Rechnung für Urheberrechte aus den Jahren 2008 und 2009 (vertraglich vereinbarte Akontozahlungen) bleibt uns ein Restbetrag von ca. 20.000 Franken.

Diesen Überschuss planen wir für Folgendes zu verwenden:

  • Die Voodoo Rhythm Bands, die Geld zur Unterstützung überwiesen haben, bekommen dieses zurück, das sind ca. 4.000 Franken

  • Wir investieren in dringend benötigte Infrastruktur. Das neue Abrechnungssystem mit der SUISA verlangt eine ordentliche Buchführung, die wir bis jetzt mit dem Beat-Man Way bestritten. Nun muss eine Buchführungssoftware, sowie einiges an Hardware angeschafft und eingerichtet werden. (Wer da helfen kann: BITTE MELDEN!) Hier haben wir noch keine Ahnung in welchem Rahmen sich diese Kosten belaufen werden, auf jeden Fall wird’s nicht billig. Das ist nötig, damit erlebte Geschichte nicht nochmals passiert und wir in Zukunft korrekt mit der SUISA abrechnen können.

  • Der Überschuss ermöglicht uns vorerst für die Bands die gleichen Deals beizubehalten (Gratisexemplare plus günstige Selbsteinkäufe der Tonträger).

  • Wir sind weiterhin in der Lage Underground-Musik zu veröffentlichen, zumindest vorerst.

  First of all.. thank you to all the people out there who wanna help voodoo rhythm to be as independent as it's possible and to keep the trust in us that we can keep on working but all in all  voodoo rhythm is runing good.. monywise we where always ok and we did pay everything we did grow alot in the last couple of years.. paralell to the free downloading we start growing couse we thought we don't wanna die and we keept on puting out hi qualitee products for little money.. vinyl records everybody can afford we did pay everything in time, pressingplants bands printers studios mastering places grafic artist delivery companies and and and.. yust to let you know that.. our bands are toring constantly .. but this letter and the money SUISA want was abit shoking and will kill us if we can not pay it... with the label we macke 0/0 or a little bit plus.. my private plus where i pay my rent and food n stuff i make with my gigs i play with reverend beat-man... anyway but....

.. Voodoo Rhythm is in troubles... it's because of a different view of the mechanical rights , Voodoo Rhythm did something illegal.. we did all or mechanical deals direct with the bands.. and didn't go over the copyright companie.. we thought it's a way better deal for our bands and for the Label.. so they have more free copies of the records and can buy the record for very cheap.. anyway we just found out with a letter from SUISA (Swiss copyright company) that this is illegal.. and they are asking for allot of money (in the beginning it was 42000.- now we are working on it to lower it down.. anyway we don't have so much money.. we is me Beat-Man and Nicole who are working for Voodoo Rhythm, we have to pay that money as fast as we can, if we can’t we have to close down Voodoo Rhythm, then we have to find a good solution for Voodoo Rhythm, cause the mechanical deal SUISA Offers is gonna break our neck sooner or later anyways, we sel our records for very cheap to foreign country’s we will have a couple of solutions.. 1st keep on working in Switzerland with a fair deal for the bands and the label, 2nd close Down Voodoo Rhythm in Switzerland and open it up In Germany and the USA … but we’ll rather stay in Switzerland cause that’s where Voodoo Rhythm belongs too

Das Plattenlabel Voodoo Rhythm und die Verwertungsgesellschaft SUISA trafen sich am 17.2 in Zürich, um über die offen stehenden Forderungen bezüglich der Urheberrechtsentschädigungen zu sprechen, und um Pläne für die Zukunft zu machen. Das Gespräch ist sehr positiv verlaufen, und mit Hilfe und des Verständnisses seitens der SUISA und der enormen Unterstützung die Voodoo Rhythm seitens der Spender erfährt, kann man vorab eines sagen: Voodoo Rhythm wird wohl erhalten bleiben können, es wird eine befriedigende Lösung gefunden werden. Weiter sind sich Voodoo Rhythm und SUSA einig darüber, in Zukunft eng miteinander zu arbeiten.

Voodoo Rhythm and SUISA met on febr 17 in Zurich  to speak about the current demands in regard to the payment of copyright compensations and future plans of collaboration. The conversation has been extremely positive from both sides involved, and with the help and understanding from the side of SUISA, as well as the huge support and donations from Voodoo Rhythm friends and fans we can proudly present this fact: Voodoo Rhythm will remain intact and continue on, and an appropriate solution will be found in the near future. 

Furthermore, Voodoo Rhythm and SUISA are dedicated to work closely with each other in future.

Преди всичко… благодарим на хората, които желаят да помогнат Voodoo Rhythm да бъде възможно най-независим и които вярват, че ние можем да продължим да работим… Въпреки всичко, засега се справяме отлично… в действителност, ние винаги сме били добре. Плащахме всичко и произведохме много в последните две години… паралелно със свободния даунлоуд, развивахме лейбъла, защото не искахме идеите ни да умрат… продължихме да предоставяме висококачествени продукти за малко пари… записи на винил, който всеки артист може да си позволи, което включва - изработката, мастерирането и графичния дизайн …ние плащахме всичко навреме… освен това, трябва да знаете, че нашите банди турнират постоянно… но, това писмо и парите, които SUISA искат от нас, бяха доста шокиращи и ще ни “убият”, ако не успеем да ги изплатим… с лейбъла ние покриваме единственно разходите или печелим много малко… моята лична печалба отива за наем, храна и други дребни неща… което правя и с концертите ми като Reverend Beat-Man… както и да е, но…

…Voodoo Rhythm е в беда …поради различния поглед върху правата в този занаят, Voodoo Rhythm е извършил нещо нелегално… правехме всички сделки директно с групите… а не с копирайт компания. Смятахме, че това е по-добре за нашите банди и за лейбъла ни… така те могат да получат повече свободни копия от продукцията и да купуват всяко едно копие много евтино…, както и да е, ние разбрахме чрез писмо от SUISA (Swiss copyright company), че това е незаконно… и те искат от нас много пари (в началото - 42000, но в момента се опитваме да намалим сумата)… както и да е, ние нямаме толкова пари… “ние” сме аз - Beat-Man и Nicole, която работи за Voodoo Rhythm. Трябва да платим тези пари колкото се може по-бързо и ако не успеем ще се наложи да затворим Voodoo Rhythm, освен това ще трябва да намерим някакво добро решение за лейбъла, защото правилата които SUISA ни предлагат, все пак рано или късно ще пречупят гръбнака ни…ние имаме две възможности, ако искаме да продаваме достатъчно евтино… първата е да продължим да работим в Швейцария с честна договорка и за бандите и за лейбъла, втората е да затворим лейбъла в Швейцария и да го отворим в Германия или САЩ … разбира се, предпочитаме да останем в Швейцария, защото това е мястото към което Voodoo Rhythm принадлежи.

Благодарим ви много за подкрепата до този момент… вълната от солидарност е забележителна и ви благодарим, че ни дадохте усещането, че правим нещо много специално за цялата музикална индустрия. Нашата гледна точка е била, е, и винаги ще бъде: “бъди креативен, като не мислиш просто да направиш нещо, а как да го направиш добре… прави свои собствени неща и вярвай в това което правиш, дори когато всички мислят че грешиш“.

По-късно:

Voodoo Rhythm и SUISA се срещнаха на 17 февруари в Цюрих, за да разговарят относно текущите искания във връзка с плащането на копирайт компенсации и бъдещи планове за сътрудничество. Разговорът беше изключително позитивен и от двете страни, и с помощта и разбирането от страна на SUISA, както и с огромния съпорт и парична помощ от приятелите и феновете на Voodoo Rhythm, ние гордо можем да изложим факта: Voodoo Rhythm остава непокътнат, продължава напред и приемливо решение ще бъде намерено скоро.

Нещо повече, Voodoo Rhythm и SUISA се посвещават на съвместна работа в бъдеще.
